Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Plated mobile application (the "Service") operated by MC Software ("we", "us", or "our").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Plated is an AI-powered food photo enhancement service. Users can upload food photos which are processed using artificial intelligence to create professional, menu-style images. The Service is available through our iOS application.

3. Account Registration

To use the Service, you must sign in using Sign in with Apple. You are responsible for maintaining the security of your account and for all activities that occur under your account.

4. Subscriptions and Purchases

• Subscriptions: We offer monthly subscription plans (Starter, Pro, and Studio) that provide a set number of photo enhancement credits per billing period.
• Credit Packs: One-time credit purchases are also available. Purchased credits do not expire.
• No Rollover: Subscription credits do not roll over to the next billing period. Unused subscription credits expire at the end of each billing cycle.
• Billing: All purchases are processed through Apple's In-App Purchase system. Payment will be charged to your Apple ID account.
• Cancellation: You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests must be made through Apple. We do not process refunds directly.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Upload images that you do not have the right to use
• Attempt to gain unauthorized access to our systems
• Use the Service to process images that are not food-related
• Resell or redistribute the Service without our permission
• Use automated systems to access the Service in a manner that exceeds reasonable use

6. Intellectual Property

• Your Content: You retain ownership of the photos you upload. By uploading photos, you grant us a limited license to process them for the purpose of providing the Service.
• Enhanced Images: You own the enhanced images created by our Service and may use them for any lawful purpose.
• Our Service: The Plated app, including its design, features, and technology, is owned by MC Software and protected by intellectual property laws.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or due to circumstances beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding any claim

9. Indemnification

You agree to indemnify and hold harmless MC Software from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
